Contract inter absentes

A contract inter absentes takes place between a merchant and a consumer who are not in each other’s presence. This occurs, for example, when a purchase is made by mail or telephone, or online.

Under this type of contract, the merchant cannot oblige the consumer to make full or partial payment before the goods are delivered, unless the merchant has paid security to the Office de la protection du consommateur.
